A Zanesville man accepted a plea agreement this (Monday) afternoon that won’t force him to serve any additional prison time in connection with his 3-year-old daughter’s death in 1994.
37-year-old Eric Scott Patterson’s trial on an involuntary manslaughter charge was set to start Tuesday, but he agreed to the deal instead, which will allow him to be credited for the time he has already served.
Patterson was convicted of the charge in June 1997 and received10 to 25 years in prison for his alleged role in the death of his daughter, Lacey Rhae.
After serving almost seven years behind bars, the conviction was thrown out because the 6th U.S. Circuit Court of Appeals ruled in 2003 that an error in jury instructions could have confused jurors and may have led them to the wrong judgement.
He was tried again the following year, but the trial ended in a hung jury.
